Terms of Service

These Terms of Service ("Terms") govern your access to and use of NewsBriefly AI ("the Service"), operated by Santosh Pandey, an individual sole proprietor based in Kathmandu, Nepal("the Operator", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (16 in the EU/EEA) to use the Service. By using the Service you represent that you have the legal capacity to enter into these Terms.

2. Your account

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@newsbrieflyai.com if you suspect unauthorized access.

3. Acceptable use

You agree not to:

  • Use the Service to infringe intellectual property rights or redistribute newsletter content beyond personal reading.
  • Attempt to access another user's data or to circumvent the Service's security or rate limits.
  • Use the Service to send spam, malware, or unlawful content.
  • Reverse engineer, decompile, or scrape the Service except as permitted by applicable law.
  • Resell, sublicense, or commercially distribute the Service or its AI-generated outputs without our prior written consent.

4. Subscriptions and billing

  • The Service offers a Free plan and a paid Pro plan (monthly or annual). Current pricing is at newsbrieflyai.com/pricing.
  • Pro includes a 14-day free trial. You may cancel at any time during the trial without charge.
  • After the trial, your subscription auto-renews at the then-current price until cancelled. You can cancel from the Stripe Customer Portal under Settings → Billing.
  • Fees are non-refundable except where required by law. If you cancel mid-cycle, you retain Pro access until the period ends.
  • We may change pricing with at least 30 days' notice; changes take effect at your next renewal.

5. AI-generated content

Summaries, key points, and topic tags are produced by third-party large language models. They may contain errors or omissions. You are responsible for verifying important information against the original article. We do not warrant the accuracy, completeness, or timeliness of AI outputs.

6. Third-party content

The Service displays content from newsletters and external article URLs that you have approved. We do not own or endorse third-party content and are not responsible for its accuracy or legality.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by the Operator. You retain all rights to your account data and to any content you submit. By using the Service, you grant us a limited, non-exclusive licence to process your data solely to provide the Service to you, as described in our Privacy Policy.

8. Termination

You may stop using the Service at any time and delete your account from Settings → Danger Zone. We may suspend or terminate your account for material breach of these Terms, with notice where practicable. Sections that by their nature survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE FEES YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold the Operator harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Service.

12. Governing law and disputes

These Terms are governed by the laws of Nepal, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the courts of Kathmandu, Nepal, except that you may bring claims in your local jurisdiction where required by consumer-protection law.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via email and at the top of this page at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
